QUESTÃO CERTA: Boi da Comuna, líder de organização criminosa no Estado do Rio de Janeiro, foi transferido por decisão fundamentada de juiz estadual para a Penitenciária Federal de Porto Velho. O juiz federal corregedor da Penitenciária Federal, ao analisar a transferência, determinou o retorno do preso ao sistema estadual, em razão de o apenado não mais exercer liderança na organização criminosa, bem como por não subsistir risco de seu retorno ao sistema penitenciário estadual. Diante da hipótese narrada, com fundamento na jurisprudência do Superior Tribunal de Justiça, a decisão do juiz federal corregedor foi: incorreta, uma vez que não cabe ao juízo federal discutir as razões do juízo estadual, quando este solicita a transferência de preso para estabelecimento prisional;
Não cabe ao Juízo Federal discutir as razões do Juízo Estadual, quando solicita a transferência de preso para estabelecimento prisional de segurança máxima, assim quando pede a renovação do prazo de permanência, porquanto este é o único habilitado a declarar a excepcionalidade da medida.
