Com relação à conduta do agressor nessa situação hipotética, julgue os seguintes itens, de acordo com a legislação pertinente e o entendimento dos tribunais superiores: Configuraram-se os crimes de ameaça, tentativa de homicídio, porte de arma de fogo e de desacato.
Considerando as informações explicitadas no enunciado da questão, pode-se concluir que o agente não responde por tentativa de homicídio. Muito embora tenha efetivamente ameaçado a ex-mulher de morte, tentado arrombar a porta de seu domicílio e portar uma arma, o agente não praticou nenhum ato executório tendente a matar a sua esposa. 3) vítima com idade igual ou superior a 14 anos, mas menor de 18 anos de idade: participação em suicídio circunstanciada (art. 122, § 3º, inc. II, 1.ª parte).
4) vítima menor de 14 anos de idade ou sem capacidade de resistência, qualquer que seja sua idade: homicídio (art. 121) ou lesão corporal gravíssima (art. 129, § 2º).

Há que se registrar que a hipótese em questão ilustra o que é conhecido no mundo jurídico como arrependimento eficaz (marcado pelo sentimento de remorso que direciona o personagem a condutas reparadoras posteriores ao seu ato). Diferentemente seria no caso de desistência voluntária, a qual, via de regra, antecede o curso de suas ações (desiste-se de dar continuidade à feitura) – não é o caso aqui. Logo, Sr. Francisco responderá por lesão consumada.
