QUESTÃO ERRADA: Consoante dispositivo constitucional, compete ao STF o processamento e julgamento de descumprimento de tratado de extradição, por ser matéria que ofende a soberania externa.
Nos termos do art. 102, I, “g”, CF/88: Compete ao Supremo Tribunal Federal, precipuamente, a guarda da Constituição, cabendo-lhe processar e julgar, originariamente a extradição solicitada por Estado estrangeiro. Note que nossa Corte Suprema julga o pedido extradicional solicitado por outro Estado, não eventual descumprimento de Tratado de extradição. Este caso suscita, em tese, uma lide entre Estados Soberanos, cuja resolução não compete ao STF, que não exerce soberania internacional. Cogita-se a mediação da Corte Internacional de Haia, consoante estabelece o art. 92 da Carta das Nações Unidas de 1945. O sistema “belga” ou da “contenciosidade limitada”, adotado pelo Brasil, investe o STF na categoria de órgão juridicamente existente apenas no âmbito do direito interno, devendo, portanto, adstringir-se a examinar a legalidade da extradição.
