QUESTÃO ERRADA: As Constituições tidas por rígidas são típicas de exercícios políticos autoritários e temporalmente ilimitados.

Negativo. Tanto que no Brasil a Constituição é rígida e não somos um governo autoritário.

QUESTÃO ERRADA: Como, no Brasil, a CF admite mudança por meio de emenda à constituição, respeitados os limites por ela impostos, ela é considerada semi-rígida.

CEBRASPE (2017):

QUESTÃO ERRADA: No que diz respeito ao direito financeiro, a CF pode ser classificada como semirrígida, uma vez que restringe a regulação de certos temas de finanças públicas a lei complementar e deixa outros à disciplina de lei ordinária.

CEBRASPE (2013):

QUESTÃO ERRADA A rigidez constitucional, importante mecanismo de defesa da constituição, relaciona-se com a dificuldade de aplicação do texto constitucional.

ERRADA. O erro está em dizer que a rigidez se relaciona com a dificuldade de aplicação do texto constitucional, quando na verdade se relaciona com a dificuldade de alteração do texto constitucional.

QUESTÃO CERTA: A Constituição que dificulte o processo tendente a modificá-la, ainda que permita emenda ou reforma, classifica-se como: rígida.

CEBRASPE (2019):

QUESTÃO ERRADA: A supremacia material da norma constitucional decorre da rigidez constitucional, isto é, da existência de um processo legislativo distinto, mais laborioso.

A supremacia material está presente em TODOS os ordenamentos constitucionais. A Supremacia formal, significa que a constituição apresenta um procedimento mais solene e dificultoso para alteração de suas normas.

CEBRASPE (2018):

QUESTÃO CERTA: O fato de o texto constitucional ter sido alterado quase cem vezes em razão de emendas constitucionais não é suficiente para classificar a vigente Constituição Federal brasileira como flexível.

A CF/1988 é classificada como rígida, dado o processo formal e solene para alteração de suas normas.

O Ministro Alexandre de Moraes, a classifica como “Super-Rígida” dado que na CF/1988 possuímos cláusulas pétreas (inalteráveis);

CF – Art. 60.º, § 4.º, I a IV.
É defeso ao poder constituinte derivado (reformador ou revisor) proceder alterações no texto Constitucional, no tocante aos tópicos enumerados nos incisos de I a IV do § 4.º, art. 60, da CF/88, quais sejam:
I – a forma federativa de Estado;
II – voto direto, secreto, universal e periódico;
III – a separação dos Poderes e;
IV – os direitos e garantias individuais.

CEBRASPE (2014):

QUESTÃO CERTA: Quanto à estabilidade, a CF pode ser classificada como rígida, já que o processo de alteração das normas constitucionais é mais dificultoso que o procedimento ordinário de criação das leis. As constituições flexíveis, por outro lado, podem ser modificadas por meio dos mesmos procedimentos de elaboração das demais leis, o que afeta seu caráter de superioridade hierárquica no ordenamento jurídico.

As Constituições podem se apresentar de forma rígida ou flexível. A diferença entre elas está na forma de alteração do seu texto. Em relação às Constituições rígidas, os critérios para a alteração do seu texto são diversos dos adotado para a criação das normas ordinárias; enquanto que em relação às Constituições flexíveis não há essa distinção. Isso nos leva à seguinte conclusão: nas Constituições rígidas há hierarquia formal entre norma constitucional e norma ordinária, o que não existe nas Constituições flexíveis, logo, em relação a estas últimas, não há que se falar em supremacia da Constituição! 

RÍGIDAS: São aquelas Constituições que exigem para sua alteração, um processo legislativo mais árduo, mais solene, mais dificultoso do que o processo de alteração das normas não constitucionais. Com exceção da Constituição de 1824 (considerada semirrígida), todas as Constituições brasileiras foram, inclusive a de 1988, rígidas. A rigidez constitucional está prevista no art.60, que por exemplo, em seu § 2º estabelece um quórum de votação de 3/5 dos membros de cada Casa, em dois (2) turnos de votação, para aprovação das emendas constitucionais.

Em contraposição, apenas para aclarar mais a situação lembrada, as votações das leis ordinárias e complementares dá-se em único turno de votação (art.65), com quórum de maioria simples (art. 47) e absoluta (art. 69), respectivamente para lei ordinária e complementar.

Outra característica da rigidez da CF/88 está prevista nos incisos I, II e III do art.60.

FLEXÍVEIS: são aquelas Constituições que não possuem um processo legislativo de alteração mais dificultoso do que o processo legislativo de alteração das normas infraconstitucionais. Vale dizer, a dificuldade de alterar a Constituição é a mesma encontrada para alterar uma lei que não é constitucional. Nesse sentido, do ponto de vista formal, devemos que, em se tratando de Constituição flexível, não existe hierarquia entre a Constituição e lei infraconstitucional, ou seja, uma lei infraconstitucional posterior altera texto constitucional se assim expressamente o declarar, quando for com ele incompatível, ou quando regular inteiramente a matéria de que se tratava a Constituição.

FUNDATEC (2012):

QUESTÃO CERTA: Alexandre de Moraes, em sua obra Direito Constitucional, Ed. Atlas (2011), acompanhando a doutrina predominante, classifica as constituições em diversas espécies, considerando a sua estabilidade. Dentre elas, apresenta a forma designada de “constituição rígida”, cuja definição apresentada pelo referido autor é a expressa na alternativa: exige procedimentos e formas mais complexos para a sua modificação, em relação àqueles utilizados para a modificação de outras espécies normativas.

QUESTÃO ERRADA: A rigidez constitucional é marca de todas as Constituições brasileiras desde, e inclusive, a de 1824.

Rígidas são aquelas Constituições que exigem, para sua alteração (…), um processo legislativo mais árduo, mais solene, mais dificultoso do que o processo de alteração das normas não constitucionais.  A rigidez e a formalidade constitucional são consequências do constitucionalismo moderno.

VUNESP (2018)

QUESTÃO ERRADA: A Constituição brasileira de 1988 é mista na sua alterabilidade, contendo uma parte plástica, outra parte rígida e um núcleo super-rígido.

A Constituição brasileira de 1988 é rígida – Classificação quanto à estabilidade (mutabilidade ou processo de modificação) – A alteração desta Constituição é possível, mas exige um processo legislativo mais complexo e solene do que aquele previsto para a elaboração das demais espécies normativas, infraconstitucionais. Tais regras diferenciadas e rigorosas são estabelecidas pela própria Constituição e tornam a alteração do texto constitucional mais complicada do que a feitura das leis comuns.

CEBRASPE (2017):

QUESTÃO ERRADA: De acordo com a teoria constitucional majoritária, a constituição é classificada como: rígida, se for passível de alterações por meio de um processo legislativo mais restrito do que o previsto para a edição de leis ordinárias.

São aquelas constituições que exigem, para a sua alteração, um processo legislativo mais árduo, mais solene, mais dificultoso do que o processo da alteração das normas não constitucionais – Pedro Lenza, Direito Constitucional Esquematizado, 2018, ed: 21ª.

CEBRASPE (2016):

QUESTÃO ERRADA: A Constituição Federal de 1988 é classificada, quanto à estabilidade, como uma Constituição flexível, o que pode ser comprovado pelo fato de seu texto já ter sofrido quase uma centena de emendas constitucionais.

FMP Concursos (2018):

QUESTÃO ERRADA: Com base no sistema de direitos e garantias fundamentais da Constituição da República Federativa do Brasil, é correto afirmar que há uma relação de precedência abstrata, valorativa e rígida a favor dos direitos coletivos quando em conflito com direitos individuais.

Se há qualquer precedência abstrata a favor dos direitos coletivos em detrimento dos individuais (o que não acredito, pois nossa Constituição é de cunho garantista), ela certamente não será rígida.

Importante lembrar que “toda Constituição rígida é, obrigatoriamente, escrita”.

Objetiva (2015):

QUESTÃO CERTA: A exigência de um procedimento mais difícil e rigoroso para alteração das normas constitucionais é típico de uma Constituição: Rígida.
