Código Penal:

   Emoção e paixão

        Art. 28/CP – Não excluem a imputabilidade penal: 

        I – a emoção ou a paixão; 

        Embriaguez

        II – a embriaguez, voluntária ou culposa, pelo álcool ou substância de efeitos análogos.

        § 1º – É isento de pena o agente que, por embriaguez completa, proveniente de caso fortuito ou força maior, era, ao tempo da ação ou da omissão, inteiramente incapaz de entender o caráter ilícito do fato ou de determinar-se de acordo com esse entendimento.

        § 2º – A pena pode ser reduzida de um a dois terços, se o agente, por embriaguez, proveniente de caso fortuito ou força maior, não possuía, ao tempo da ação ou da omissão, a plena capacidade de entender o caráter ilícito do fato ou de determinar-se de acordo com esse entendimento.

CEBRASPE (2018):

QUESTÃO CERTA: A imputabilidade é definida como: a capacidade mental, inerente ao ser humano, de, ao tempo da ação ou da omissão, entender o caráter ilícito do fato e de determinar-se de acordo com esse entendimento.

CEBRASPE (2017):

QUESTÃO CERTA: Um dos elementos da culpabilidade, a imputabilidade será excluída no caso de o agente atuar sob o estado de embriaguez completa: fortuita.

CEBRASPE (2016):

QUESTÃO CERTA: Constitui causa que exclui a imputabilidade a: embriaguez acidental completa proveniente da ingestão de álcool.

A emoção e a paixão não excluem a imputabilidade penal, nos termos do art. 28, I do CP. Da mesma forma, a embriaguez preordenada não exclui a imputabilidade, sendo, inclusive, uma agravante (art. 62, I, “L” do CP). A embriaguez culposa também não exclui a imputabilidade penal do agente (art. 28, II do CP).

Por fim, a embriaguez ACIDENTAL (decorrente de caso fortuito ou força maior) completa (aquela que retira completamente do agente a capacidade de entender o caráter ilícito do fato ou de determinar-se de acordo com este entendimento) é causa de exclusão da imputabilidade penal, nos termos do art. 28, §1º do CP.

CEBRASPE (2016):

QUESTÃO ERRADA: Situação hipotética: João, em estado de embriaguez voluntária, motivado por ciúme de sua ex-mulher, matou Paulo. Assertiva: Nessa situação, o fato de João estar embriagado afasta o reconhecimento da motivação fútil, haja vista que a embriaguez reduziu a capacidade de entender o caráter ilícito de sua conduta.

A embriaguez voluntária em nada afasta a qualificadora do homicídio muito menos sua imputabilidade.

ERRADA – Situação hipotética: João, namorado de Maria e por ela apaixonado, não aceitou a proposta dela de romper o compromisso afetivo porque ela iria estudar fora do país, e resolveu mantê-la em cárcere privado. Assertiva: Nessa situação, a atitude de João enseja o reconhecimento da inimputabilidade, já que o seu estado psíquico foi abalado pela paixão.

A emoção e a paixão não excluem a imputabilidade penal. (Art. 28 do Código Penal).

CEBRASPE (2016):

QUESTÃO CERTA: Situação hipotética: Elizeu ingeriu, sem saber, bebida alcoólica, pensando tratar-se de medicamento que costumava guardar em uma garrafa, e perdeu totalmente sua capacidade de entendimento e de autodeterminação. Em seguida, entrou em uma farmácia e praticou um furto. Assertiva: Nesse caso, Elizeu será isento de pena, por estar configurada a sua inimputabilidade.

Exclui-se a imputabilidade em virtude de embriaguez completa proveniente de caso fortuito ou de força maior. (art. 28 do Código Penal).

CEBRASPE (2023):

QUESTÃO ERRADA: É isento de pena o agente que, por embriaguez completa culposa, era, ao tempo da ação, inteiramente incapaz de entender o caráter ilícito do fato.

CEBRASPE (2023):

CEBRASPE (2022):

QUESTÃO CERTA: João, com 20 anos de idade e imputável, ingeriu bebida alcoólica durante uma festa e, embora não tivesse a intenção de se embebedar ou de praticar crimes, ficou completamente embriagado e desferiu socos em um desafeto, causando-lhe lesões corporais gravíssimas. Na situação hipotética apresentada, a embriaguez foi completa e Alternativas A culposa, mas não exclui a imputabilidade penal.

CP:
