A LDO deve retornar ao Chefe do Executivo (ou seja, aprovada pelo Poder Legislativo) até 17/07 que é a data do início do recesso da Sessão Legislativa. Lembrando que a sessão legislativa NÃO SERÁ INTERROMPIDA enquanto não for aprovada a LDO.
A questão chamou o dia 17/07 de ” meados do segundo semestre de cada ano “.
QUESTÃO ERRADA: A Lei de Diretrizes Orçamentárias compreende as metas e prioridades da administração pública federal, devendo ser aprovada pela Câmara dos Deputados e enviada à sanção presidencial até o dia 31 de agosto do ano anterior à sua vigência.
Comentário: existem dois erros! O primeiro é acerca da aprovação, pois não cabe apenas à Câmara dos Deputados aprovar a LDO. O segundo erro é que a sanção presidencial deverá ocorrer até o dia 17/07.
QUESTÃO ERRADA: A vigência das diretrizes orçamentárias é restrita ao exercício financeiro correspondente à lei orçamentária anual a que elas se refiram.
“(A LDO) deve ser encaminhada ao Congresso Nacional até o dia 15 de abril de cada ano. Embora sendo encaminhada periodicamente a cada ano, a sua vigência é superior a um exercício, ou seja, desde a sua aprovação até o final do exercício seguinte.
Com a sua aprovação e promulgação, imediatamente ela irá lançar sua força normativa sobre o Projeto de Lei Orçamentária Anual a ser enviado ao Legislativo até o final de agosto. Esse projeto vigorará até o final do exercício seguinte, e durante toda a sua vigência deverá obedecer às orientações emanadas da LDO respectiva.
Portanto, a vigência da Lei de Diretrizes Orçamentárias, se considerarmos os meses, é de 18 meses, e se considerarmos os anos, de 2 anos. Desde a sua aprovação, que deve ocorrer até o final do primeiro período da sessão legislativa (17/7), até o final do exercício financeiro seguinte (31/12).”
QUESTÃO ERRADA: O presidente da República deve encaminhar o PPA e a LDO ao Congresso Nacional até quatro meses antes do encerramento do primeiro exercício financeiro. A devolução do PPA e da LDO para sanção deverá ocorrer até o encerramento da sessão legislativa.
Estaria certa a questão se ao invés de LDO estivesse escrito LOA.
Prazos:
PPA: envia 31 agosto (4 meses antes do fim do exercício), devolução 22/12 (encerramento da sessão leg.)
LDO: 15/04 (oito meses e meio antes do fim do ex.), 17/07 (fim do primeiro período da sessão legislativa)
LOA: 31/08, 22/12 = PPA
