Art. 180 – Adquirir, receber, transportar, conduzir ou ocultar, em proveito próprio ou alheio, coisa que sabe ser produto de crime, ou influir para que terceiro, de boa-fé, a adquira, receba ou oculte:

Receptação qualificada
§ 1º – Adquirir, receber, transportar, conduzir, ocultar, ter em depósito, desmontar, montar, remontar, vender, expor à venda, ou de qualquer forma utilizar, em proveito próprio ou alheio, no exercício de atividade comercial ou industrial, coisa que deve saber ser produto de crime:
Pena – reclusão, de três a oito anos, e multa.
§ 2º – Equipara-se à atividade comercial, para efeito do parágrafo anterior, qualquer forma de comércio irregular ou clandestino, inclusive o exercício em residência.
§ 3º – Adquirir ou receber coisa que, por sua natureza ou pela desproporção entre o valor e o preço, ou pela condição de quem a oferece, deve presumir-se obtida por meio criminoso:
Pena – detenção, de um mês a um ano, ou multa, ou ambas as penas.
§ 4º – A receptação é punível, ainda que desconhecido ou isento de pena o autor do crime de que proveio a coisa.
§ 5º – Na hipótese do § 3º, se o criminoso é primário, pode o juiz, tendo em consideração as circunstâncias, deixar de aplicar a pena. Na receptação dolosa aplica-se o disposto no § 2º do art. 155.
§ 6o Tratando-se de bens do patrimônio da União, de Estado, do Distrito Federal, de Município ou de autarquia, fundação pública, empresa pública, sociedade de economia mista ou empresa concessionária de serviços públicos, aplica-se em dobro a pena prevista no caput deste artigo.
Receptação de animal
Art. 180-A. Adquirir, receber, transportar, conduzir, ocultar, ter em depósito ou vender, com a finalidade de produção ou de comercialização, semovente domesticável de produção, ainda que abatido ou dividido em partes, que deve saber ser produto de crime:
Pena – reclusão, de 2 (dois) a 5 (cinco) anos, e multa
QUESTÃO CERTA: Um indivíduo, sem antecedentes criminais, que, consertando e vendendo telefones celulares novos e usados, exercia comércio clandestino no quintal de casa, expôs à venda, em certa ocasião, um celular roubado avaliado em R$ 3.000. Ao ser indagado sobre a procedência do bem, o comerciante alegou que o comprara de um desconhecido, sem recibo ou nota fiscal. Embora não tenha ficado esclarecido como o celular chegara às suas mãos ou quem o subtraíra, é inquestionável a procedência criminosa, já que a vítima, quando do roubo, havia registrado na delegacia a ocorrência do fato, o qual fora confirmado por testemunhas oculares. Nessa situação hipotética, tal indivíduo responderá pela prática de crime de: receptação qualificada, mesmo que a autoria do crime anterior não seja apurada, por tratar-se de crime parasitário ou acessório.
Receptação qualificada (dolo eventual + dolo direto)
§ 1º – Adquirir, receber, transportar, conduzir, ocultar, ter em depósito, desmontar, montar, remontar, vender, expor à venda, ou de qualquer forma utilizar, em proveito próprio ou alheio, no exercício de atividade comercial ou industrial, coisa que deve saber ser produto de crime:
Pena – reclusão, de três a oito anos, e multa.
§ 2º – Equipara-se à atividade comercial, para efeito do parágrafo anterior, qualquer forma de comércio irregular ou clandestino, inclusive o exercício em residência.
A receptação só existe se houver um crime anterior/pretérito.
– Receptação própria: “agente sabendo ser a coisa produto de crime’’.
– Receptação imprópria: “ou influir para que terceiro, de boa-fé, a adquira, receba ou oculte”.
– Receptação culposa: único crime contra o patrimônio que admite a forma culposa. “deve presumir-se obtida por meio criminoso”. CULPA
– Receptação qualificada: (crime próprio) cometido apenas por aquele que se encontra no exercício de atividade comercial ou industrial, coisa que deve saber ser produto do crime. DOLO EVENTUAL + DOLO DIRETO.
É um crime material, exceto na modalidade imprópria (basta a influência sobre o terceiro de boa-fé).
Perdão Judicial:
– Apenas na modalidade culposa.
– Desde que seja o autor primário e ter agido com culpa levíssima.
Causa de diminuição de pena 1/3 a 2/3 ou multa:
– Nas formas dolosas;
– Agente primário;
– Pequeno o valor da coisa.

Em razão de denúncia anônima a respeito do desvio de medicamentos, Juan, portando caixas de remédios retiradas do local, foi abordado em seu automóvel por policiais logo após ter saído do posto e foi, então, conduzido à delegacia. Para que seu verdadeiro nome não fosse descoberto, Juan identificou-se à autoridade policial como Pedro Rodríguez, buscando, assim, evitar o cumprimento de mandado de prisão expedido por ter sido condenado pelo crime de moeda falsa no Brasil. Questionado sobre a propriedade do veículo no qual se encontrava no momento da abordagem, Juan informou tê-lo comprado de uma pessoa desconhecida, em Boa Vista. Durante a investigação policial, verificou-se que o veículo havia sido furtado por outra pessoa no Brasil e que a placa estava adulterada. Verificou-se, ainda, que a placa identificava um veículo registrado no país de origem de Juan e em seu nome, embora Juan tivesse alegado ter adquirido o veículo já com a referida placa. Considerando essa situação hipotética, julgue o item que se segue. Juan deverá responder por participação no crime de furto do veículo que adquiriu, apesar de o autor do crime ter sido outra pessoa.

O crime de receptação pode ser:
1 – Receptação (dolosa) própria -> Art.180 1º parte – Adquirir, receber, transportar, conduzir ou ocultar, em proveito próprio ou alheio, coisa que sabe ser produto de crime.
2 – Receptação (dolosa) imprópria -> Art.180 2º parte – Influir para que terceiro, de boa-fé, a adquira, receba ou oculte coisa que sabe ser produto de crime.
3 – Receptação CULPOSA -> Art.180 § 3º -> adquirir ou receber coisa que, por sua natureza ou pela desproporção entre o valor e o preço, ou pela condição de quem a oferece, deve presumir-se obtida por meio criminoso.
QUESTÃO CERTA: Depois de adquirir um revólver calibre 38, que sabia ser produto de crime, José passou a portá-lo municiado, sem autorização e em desacordo com determinação legal. O comportamento suspeito de José levou-o a ser abordado em operação policial de rotina. Sem a autorização de porte de arma de fogo, José foi conduzido à delegacia, onde foi instaurado inquérito policial. Tendo como referência essa situação hipotética, julgue o item seguinte. RECEPTAÇÃO IMPRÓPRIA (2° parte do caput do artigo) – Aqui o agente não adquire o bem, mas, sabendo que é produto de crime, influencia para que outra pessoa, que age de boa-fé, adquira o bem. A consumação, na receptação própria, se dá com a efetiva inclusão da coisa na esfera de posse do agente (crime material). Já a receptação imprópria é crime formal
QUESTÃO ERRADA: Na madrugada do dia 20/8/2012, Francisco, escalou o muro que cercava determinada residência e conseguiu entrar na casa, onde anunciou o assalto aos moradores. Francisco ameaçou cortar a garganta das vítimas com um caco de vidro, caso elas gritassem por socorro ou tentassem chamar a polícia. Ele então amarrou as vítimas, explodiu o cofre localizado no andar de cima da casa e subtraiu as joias que encontrou. Essas joias foram vendidas a Paulo, que desconhecia a origem do produto por ele adquirido. Ao adquirir as joias roubadas, Paulo praticou o crime de receptação.
Resposta: Errada.
