A maior parte delas fica sujeita à discricionariedade administrativa diante de cada caso concreto; é a autoridade julgadora que vai enquadrar o ilícito como ‘falta grave’, ‘procedimento irregular’, ‘ineficiência no serviço’, ‘incontinência pública’, ou outras infrações previstas de modo indefinido na legislação estatutária. Para esse fim, deve ser levada em consideração a gravidade do ilícito e as consequências para o serviço público.”
