O Que São Concausas? (com exemplos)

QUESTÃO CERTA: A superveniência de causa relativamente independente da conduta do agente excluirá a imputação do resultado nos casos em que, por si só, ela tiver produzido o resultado.

Basicamente há duas espécies de concausas: as absolutamente independentes e as relativamente independentes. Ambas se subdividem em preexistentes, concomitantes e supervenientes.

Quando houver a concausa absolutamente independente em todas as suas modalidades (preexistente, concomitante ou superveniente) o agente só responderá pelo que efetivamente praticou.

Quando houver a concausa relativamente independente nas modalidades preexistentes e concomitantes, o agente responderá pelo crime consumado. Por outro lado, quando houver a concausa relativamente independente superveniente, o agente SÓ NÃO responderá pelo crime consumado se a concausa for, POR SI SÓ, apta a gerar o resultado, nesse caso responderá só pelo que praticou. Caso a concausa não for apta, o agente responderá pelo crime consumado.

Relação de causalidade

       Art. 13 – O resultado, de que depende a existência do crime, somente é imputável a quem lhe deu causa. Considera-se causa a ação ou omissão sem a qual o resultado não teria ocorrido. 

        Superveniência de causa independente

       § 1º- A superveniência de causa relativamente independente exclui a imputação quando, por si só, produziu o resultado; os fatos anteriores, entretanto, imputam-se a quem os praticou. 

        Relevância da omissão

       § 2º – A omissão é penalmente relevante quando o omitente devia e podia agir para evitar o resultado. O dever de agir incumbe a quem:

       a) tenha por lei obrigação de cuidado, proteção ou vigilância; 

       b) de outra forma, assumiu a responsabilidade de impedir o resultado; 

       c) com seu comportamento anterior, criou o risco da ocorrência do resultado. 

QUESTÃO ERRADA: A concausa preexistente absolutamente independente reforça o nexo entre a ação do agente e o resultado, não retirando a consumação do crime praticado pelo ofensor.

A concausa absolutamente independente não reforça o nexo causal e sim ROMPE.

Na concausa absolutamente independente a causa efetiva do resultado não se origina, direta ou indiretamente do comportamento concorrente. Por ser preexistente, ela antecede o comportamento concorrente e dá causa ao resultado. Dessa forma, ela NÃO reforça o nexo entre a ação do agente e o resultado. Ela é absolutamente independente.

Temos como exemplo a mulher que envenena o marido e posteriormente um desafeto atira no mesmo indivíduo. Socorrido, o agente morre em razão do envenenamento anterior realizado pela esposa. O indivíduo com o comportamento posterior não dá causa ao resultado e, portanto, retira-se a consumação do delito de sua responsabilidade, respondendo apenas por tentativa nos casos em que a lei autoriza.

Nas concausas absolutamente independente, não importa a espécie (preexistente, concomitante ou superveniente), o comportamento paralelo será sempre punido na forma TENTADA.

QUESTÃO ERRADA: João, com a intenção de matar José, seu desafeto, efetuou disparos de arma de fogo contra ele. José foi atingido pelos projéteis e faleceu. Considere que, depois de feitos os exames necessários, se tenha constatado uma das seguintes hipóteses relativamente à causa da morte de José: Apesar dos disparos sofridos pela vítima, a causa determinante da sua morte foi intoxicação devido ao fato de ela ter ingerido veneno minutos antes de ter sido alvejada.

Trata de uma causa absolutamente independente preexistente, devendo somente responder pelos atos já praticados e não pelo resultado morte, já que este teria ocorrido independentemente de João ter efetuado os disparos. Desta forma, só responderá por tentativa de homicídio.

QUESTÃO ERRADA: João, com a intenção de matar José, seu desafeto, efetuou disparos de arma de fogo contra ele. José foi atingido pelos projéteis e faleceu. Considere que, depois de feitos os exames necessários, se tenha constatado uma das seguintes hipóteses relativamente à causa da morte de José: A morte decorreu de ferimentos causados por disparos de arma de fogo efetuados por terceiro no mesmo momento em que João agiu e sem o conhecimento deste.

Trata de uma causa absolutamente independente concomitante, devendo somente responder pelos atos já praticados e não pelo resultado morte, já que este ocorreu devido aos disparos efetuados por terceiro e não pela ação de João. Por conseguinte, só responderá por tentativa de homicídio.

QUESTÃO CERTA: João, com a intenção de matar José, seu desafeto, efetuou disparos de arma de fogo contra ele. José foi atingido pelos projéteis e faleceu. Considere que, depois de feitos os exames necessários, se tenha constatado uma das seguintes hipóteses relativamente à causa da morte de José:   A vítima faleceu em razão dos ferimentos sofridos, os quais foram agravados por sua condição de hemofílica.

Trata de uma causa relativamente independente preexistente, uma vez a condição preexistente de homofílica agravou a situação, neste caso João responde pelo resultado, ou seja, pelo crime de homicídio.

QUESTÃO CERTA: João, com a intenção de matar José, seu desafeto, efetuou disparos de arma de fogo contra ele. José foi atingido pelos projéteis e faleceu. Considere que, depois de feitos os exames necessários, se tenha constatado uma das seguintes hipóteses relativamente à causa da morte de José:  A morte decorreu de uma infecção hospitalar que acometeu a vítima quando do tratamento dos ferimentos causados pelos tiros.

Trata de uma causa relativamente independente superveniente, a concausa (infecção hospitalar) só ocorreu devido aos ferimentos ocasionados pelos disparos de João, nesse ínterim, o agente irá responder por homicídio, já que a concausa não produziu por si só o resultado.

No caso das concausas:

 – Absolutamente independentes (preexistentes, concomitantes e supervenientes): o agente responde apenas pelos atos já praticados.

– Relativamente independentes (preexistentes e concomitantes): responde pelo resultado.

No caso de causas relativamente supervenientes, há duas situações:

 * se por si só causou o resultado: responde apenas pelos atos já praticados (caso que, embora seja relativamente independente, tem resultado como se fosse absolutamente independente). Aqui aplica-se a teoria da causalidade adequada, fugindo da regra adotada pelo CP (equivalência das condições – “sine qua non”):

Art. 13. § 1º – A superveniência de causa relativamente independente exclui a imputação quando, por si só, produziu o resultado; os fatos anteriores, entretanto, imputam-se a quem os praticou.

* se não por si só (agrega-se ao desdobramento natural) causou o resultado: responde pelo resultado (mantém a regra das concausas relativamente independentes).

QUESTÃO ERRADA As causas supervenientes relativamente independentes possuem relação de causalidade com conduta do sujeito e não excluem a imputação do resultado.

QUESTÃO CERTA: As causas concomitantes absolutamente independentes não possuem relação de causalidade com a conduta do sujeito e excluem o nexo causal.

QUESTÃO ERRADA: Situação hipotética: A vítima Lúcia foi alvejada e ferida por disparo de arma de fogo desfechado por Aldo, que agiu com animus laedandi. Internada em um hospital, Lúcia faleceu não em decorrência dos ferimentos sofridos, mas em razão de queimaduras causadas por um incêndio que destruiu toda a área de internação dos enfermos. Assertiva: Nessa situação, e considerando a teoria da equivalência dos antecedentes ou da conditio sine qua non, Aldo será responsabilizado criminalmente pelo resultado naturalístico (morte).

Incêndio é considerado uma concausa relativamente independente, não previsível (geralmente não há fogo em hospitais). Essa concausa é superveniente e está prevista no art. 13, § 1º, do CP. (teoria da causalidade adequada). É relativamente independente porque se o agente não tivesse dado um tiro na vítima, ela não teria ido ao hospital. Contudo, como fogo é algo não previsível (por si só produziu o resultado), o agente responderá pelos atos praticados, que no exemplo da questão, será pela lesão corporal, pois o agente teve animus laedandi, ​ou seja, intenção de prejudicar ou ferir;

Exemplos clássicos de causas relativamente independentes que produzem por si só o resultado e o agente responde por TENTATIVA (pois não está na linha do desdobramento normal da conduta do agente):

A) incêndio do hospital

B) inundação do hospital

C) queda do teto do hospital

D) acidente fatal de trânsito com a ambulância que transportava a vítima.

Causas independentes: Produzem o resultado, guardando ALGUMA ou NENHUMA relação com a conduta do agente:

a)      ABSOLUTAS (absolutamente independentes): Aquela que POR SI SÓ produz o resultado, independentemente da conduta do agente. Caso do ataque cardíaco. “E quer matar F. Para tanto, o agente coloca veneno na comida vítima que vem a falecer antes de ingeri-la, em decorrência de um ataque cardíaco fulminante”. -> Aqui o agente no máximo responderá por tentativa de homicídio, CASO tenha iniciado a execução do crime.

b)      RELATIVAS (relativamente independentes): Aquelas que por si só NÃO PRODUZEM o resultado, sendo A CONDUTA DO AGENTE DECISIVA para sua produção. O agente, em regra, responde pelo resultado. Caso típico: hemofilia. “G provoca lesão corporal em H sabendo que este é portador de hemofilia (concausa). H sangra até a morte. G responderá por homicídio doloso, aliado à concausa, que foi determinante para o resultado”.

Exceção: Causas supervenientes relativamente independentes que por si só produzem o resultado. Aqui o agente não responde pelo resultado, mas pelo que efetivamente causou [art. 13,§1º do CP]. “I desfere tiros em J que é socorrido, no caminho a ambulância explode. A causa da morte de J foi a explosão. Logo, J responde por tentativa de homicídio. Nesse caso é aplicada a teoria da causalidade adequada, segundo a qual causa é tudo aquilo apto e suficiente à produção do resultado.

Então colegas, a grande sacada da questão é sobre a previsibilidade da causa. Depois que a gente entende não fica tão difícil utilizar a teoria na prática. Uma dica para esses exemplos de hospital:

*Se a vítima, ferida de bala intencionalmente está no Hospital em que há muitos pacientes graves e, em razão desse fato, é impossível dar-lhe pronto atendimento, caso venha a falecer é do agente (que desferiu os tiros intencionalmente) a responsabilidade pelo resultado morte. Pois a demora, no caso, é natural da realidade dos hospitais e esse fato é conhecimento pelo homem médio. (Causa relativamente independente)

*Se no mesmo exemplo, a vítima que está no hospital morre porque uma parede do ambulatório desaba sobre seu corpo, matando-a, esse fato não é previsível do cotidiano. Não é normal que pacientes morram em hospitais pelo desabamento de paredes. Logo, o agente que desferiu os tiros na vítima hospitalizada apenas responderá por tentativa de homicídio. (Causa superveniente relativamente independente que por si só produzem o resultado)
