QUESTÃO ERRADA: Samuel disparou, sem querer, sua arma de fogo em via pública. Nessa situação, ainda que o disparo tenha sido de forma acidental, culposamente, Samuel responderá pelo crime de disparo de arma de fogo, previsto no Estatuto do Desarmamento.

Disparo acidental é fato atípico. Samuel não poderá responder culposamente. ERRADA.

Art. 15. Disparar arma de fogo ou acionar munição em lugar habitado ou em suas adjacências, em via pública ou em direção a ela, desde que essa conduta não tenha como finalidade a prática de outro crime: 

Pena – reclusão, de 2 (dois) a 4 (quatro) anos, e multa.

QUESTÃO CERTA: Dalva, em período gestacional, foi informada de que seu bebê sofria de anencefalia, diagnóstico confirmado por laudos médicos. FGV (2022):

QUESTÃO CERTA: Sydney complementa sua renda familiar com a intermediação da venda de embarcações de médio porte. Considerando que as embarcações, a despeito de serem bens móveis, necessitam de registro na Capitania dos Portos (artigo 3º da Lei 7.6525/88) e que os bens imóveis necessitam de matrícula no Registro de Imóveis, pode-se afirmar que a conduta de Sydney, que não possui registro no Conselho Regional de Corretores de Imóveis, ao intermediar a venda de embarcações: é atípica. 

Em nenhum momento a questão apontou alguma conduta irregular de Sydney. Sydney intermedeia a venda de embarcações, as quais são tidas por lei como bens imóveis, ou seja, Sydney desempenha atribuições de um corretor de imóveis sem possuir, no entanto, registro no Conselho de Corretores, o que é necessário para exercer essa atividade, segundo a questão. Assim, a conduta cujo caráter criminoso se analisa é exercer a atividade de corretor de imóveis sem possuir o registro no Conselho Profissional, o que não configura crime algum (é atípica).

Além disso, é Livre Constituição de Associações sem a obrigação de pedir autorização do governo e sem que ele possa interferir em seu funcionamento.

Quase todos os crimes desse capítulo são praticados com o uso de violência ou grave ameaça.
